Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and Kanadský Otočný Dům ("we", "us", or "our") governing your access to and use of this website and any reservation you make through it. By browsing this website, requesting a quote, or completing a booking you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, you must not use this website or make a booking.

Kanadský Otočný Dům

Every reservation made through this website is a direct contract between you and Kanadský Otočný Dům. The cancellation, refund, payment, deposit, check-in, check-out, and house-rules terms shown to you at the moment you confirm the booking govern that booking and prevail over anything in this document if there is a conflict.

We may refuse, cancel, or shorten any booking at our sole discretion if we have a reasonable basis to believe that you have provided false or misleading information, that you intend to violate the house rules or applicable law, that your stay would create a safety, health, or reputational risk, or that the booking is fraudulent. In that case our only obligation is to refund the amount you paid for the unused portion of the booking, less any costs we have already incurred.

This website is built and hosted on Resify, a software platform that provides booking-website infrastructure to accommodation operators. Resify is a technology provider only. Resify is not a party to your booking contract, is not the merchant of record, does not own or operate the property, and bears no liability for the contents of this website, its availability, the conduct of Kanadský Otočný Dům, or any reservation made through it. Any claim you may have arising out of your booking or your stay must be brought against Kanadský Otočný Dům and not against Resify.

You must be at least 18 years old and legally able to enter into a binding contract to make a booking. You agree to provide accurate, current, and complete information when you book and to keep that information current. We may refuse a booking if we suspect the information you have provided is inaccurate, incomplete, or fraudulent.

Prices shown on this website are in the displayed currency and are valid only at the moment of display. Pricing, availability, and included taxes and fees may change at any time without notice. The price that applies to your booking is the price shown on the booking confirmation, together with any taxes, tourist fees, deposits, and local charges identified at checkout or required by law.

Payments are processed by Stripe. Card details are entered into Stripe's secure form and are never stored on this website or by us. You authorize Kanadský Otočný Dům and Stripe to charge your payment method for the booking, any deposits, any pre-authorisations, any damage charges permitted under section 8, and any other amounts you owe under the booking confirmation or these Terms.

The cancellation and refund policy that applies to your booking is the policy shown to you at checkout and recorded on your booking confirmation. We have no obligation to refund any amount outside what that policy provides. No-shows and early departures are treated as cancellations and are subject to the same policy. Modifications (date changes, room changes, guest count changes) are at our sole discretion and may be subject to a price difference.

You agree to comply with the house rules of the property and with any reasonable instructions given by us or our staff during your stay. We may require valid government-issued identification at check-in for every guest in your party. We may refuse entry, terminate your stay without refund, and remove you and your party from the property if you breach the house rules, behave in a manner that disturbs other guests or neighbours, damage the property, or violate applicable law.

You are liable for any damage you or anyone in your party causes to the property, its furnishings, fixtures, equipment, or grounds, whether accidental or intentional, and for any cleaning costs above the normal standard required as a result of your stay. We may charge the actual cost of repair, replacement, or extra cleaning to the payment method on file, up to the amount we reasonably determine, without further notice. You also remain liable for any amount in excess of what we are able to recover that way.

Photos, descriptions, floor plans, amenity lists, and other content on this website are good-faith representations of the property and are provided for general information only. Minor differences between the content shown and the property as delivered (lighting, decor changes, temporary maintenance, seasonal differences, partial-view rooms within a category, etc.) do not entitle you to a refund or any other remedy. Where this website displays content imported from third-party sources (including Airbnb and Booking.com), that content is provided as-is and we are not responsible for its accuracy.

You agree that you will not use this website for any unlawful or fraudulent purpose, will not submit false bookings or use a payment method that is not yours or that you are not authorised to use, will not scrape, crawl, harvest, or systematically download content, will not interfere with or disrupt the website, its security, or the underlying infrastructure, and will not use it to send spam, harassing messages, or any communications prohibited by law. We may suspend or terminate your access at any time without notice and without liability.

We are not liable for any failure or delay in performing our obligations under your booking that is caused by an event outside our reasonable control, including (without limitation) acts of God, weather, fire, flood, earthquake, pandemic or epidemic, public-health measures, government action, war, civil unrest, terrorism, strikes or labour disputes, transportation disruption, utility outages, internet or telecommunications failures, software or third-party service failures, and shortage of materials or supplies. In such an event our only obligation is the one stated in your booking's cancellation policy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS WEBSITE AND ALL INFORMATION, CONTENT, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE WEBSITE WILL BE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, GOODWILL, ENJOYMENT OF HOLIDAY, OR ALTERNATIVE-ACCOMMODATION COSTS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR BOOKING, YOUR STAY, OR YOUR USE OF THIS WEBSITE IS LIMITED TO THE AMOUNT YOU ACTUALLY PAID FOR THE BOOKING GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND US.

You agree to defend, indemnify, and hold harmless Kanadský Otočný Dům and its owners, officers, directors, employees, and agents from and against any and all claims, demands, losses, damages, liabilities, fines, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of this website, (b) your booking or stay, (c) any damage you or anyone in your party causes, (d) your violation of these Terms or of any applicable law, or (e) your violation of any third party's rights.

These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of the jurisdiction in which Kanadský Otočný Dům is established, without regard to its conflict-of-laws rules. The courts of that jurisdiction have exclusive jurisdiction to settle any dispute. Any claim must be brought within one (1) year after it arose, or it is permanently barred.

We may update these Terms at any time at our sole discretion. The updated version takes effect as soon as it is posted on this website. Your continued use of this website or any new booking made after that time constitutes your acceptance of the updated Terms. The version that governs an existing booking is the version that was in force at the time the booking was confirmed.

These Terms, together with our Privacy Policy and the booking confirmation we send you, constitute the entire agreement between you and us regarding your use of this website and any booking made through it. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in full force.
